1. Acceptance of Terms

By accessing and using OpenTenders ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

OpenTenders provides a tender aggregation and notification service. We collect and display tender information from various public sources and provide email alerts to subscribers based on their preferences.

While we strive to provide accurate and timely information, we do not guarantee the completeness, accuracy, or timeliness of any tender information displayed on our platform.

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use of your account

4. Subscription and Payment

Subscription fees are billed in advance on a monthly, quarterly, or annual basis depending on the plan you select. Your subscription will automatically renew unless cancelled before the renewal date.

All payments are processed securely through PayFast. We do not store your payment card details.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• No refunds will be provided for partial subscription periods

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools to scrape or download content from the Service
• Share your account credentials with others
• Resell or redistribute content from the Service without permission

7. Intellectual Property

The Service and its original content, features, and functionality are owned by OpenTenders and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. TENDER INFORMATION IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY, AND YOU SHOULD VERIFY ALL INFORMATION WITH THE ORIGINAL SOURCE BEFORE TAKING ANY ACTION.

9. Limitation of Liability

IN NO EVENT SHALL OPENTENDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
